Official Rules
THIS IS A CONTEST OF SKILL, NOT A LOTTERY OR SWEEPSTAKES.
Sponsor: The Sponsor of the $11,000 Contest That Changes Lives (the “CONTEST”) is Take Action Family, Inc. dba Scornavacco Martial Arts Academy 1830 Boston Avenue Suite F Longmont, CO 80501 (“Sponsor” or “Administrator”).
Eligibility: $11,000 Contest That Changes Lives (the “CONTEST”) is open only to natural persons who are at least 18 years old at the time of entry and reside in the Continental United States. Employees, officers and representatives of Sponsor and its related companies and each of their respective officers, directors, employees, shareholders, and agents (collectively, “CONTEST Entities”), as well as the immediate family (spouse, parents, siblings, and children) and household members of each such individual (whether related or not) are not eligible. Subject to all federal, state and local laws and regulations. Odds of winning in this particular CONTEST depend on the number of eligible entries received for the CONTEST and the level of skill exhibited by the contestant. Winners for a designated Contest will be determined based upon the contents of the story and writing skills. Because this is a “Contest of Skill”, there are no “odds” of a particular contestant being the final winner. However, Sponsor reasonably anticipates that the Contest prize will be awarded from the total number of contestant entries, once the Sponsor elects to close the Contest. Void outside the State of Colorado.
Agreement to Official Rules: By participating in the CONTEST, each entrant unconditionally agrees to and accepts these Official Rules and the decisions of Sponsor, which are final and binding in all matters related to the CONTEST.
How to Enter:
To enter the CONTEST you must:
1. Submit a completed entry form to include accurate Contestant Name, Email Address, City and State, Phone Number, and an Essay of 250-450 words written in the English language and turned in to 1830 Boston Avenue Suite F Longmont, CO 80501 or emailed to office@scornavacco.com. The topic must discuss why you are the perfect family to win this contest. Essay shall be considered a work for hire and owned by Contest Sponsor upon submission. Contestant shall retain a license to use the submission in their own self promotional efforts and Sponsor shall only use the essay with authorship attribution to the Contestant author.
2. You MUST enroll, or be enrolled, in any martial arts program offered by Scornavacco Martial Arts Academy by Thursday, March 31, 2012. If you don’t enroll, then you are disqualified from participating in the contest.
3. Provide accurate Contestant Name, Email Address, and proof of purchase from Scornavacco Martial Arts Academy by Thursday, March 31, 2012. Contestant Name and Email Address supplied must match information supplied via the completed entry form as described in item 1 above.
4. Finalists MUST Provide valid Social Security Number or EIN and submit to criminal background check.
5. Winner agrees to have all sessions, whether in person, on phone, by email, conducted by Scornavacco Martial Arts Academy or any of its partners or affiliates recorded by video or audio means and may be used in promotional materials by Scornavacco Martial Arts Academy or any of its partners or affiliates.
During the CONTEST period from 12:01 a.m. Mountain Time (“MT”), January 1st, 2010, and 11:59 p.m. MT, March 31, 2012, (the “Promotion Period”).
After you have fully completed the entry form and submitted the required information, you will automatically receive one (1) entry into the CONTEST per complete entry submission. Limit One Entry per Contestant. The judges results are final, incontestable, and at the complete discretion of the Contest Sponsor.
All online entries must be received during the Promotion Period. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.
Disqualification: Finalists will be subject to CRIMINAL background check. Sponsor may disqualify an entrant at its sole and full discretion based on the results of a background check or any other reason. Finalists must provide identifying documentation to facilitate criminal background check which may include, but may not be limited to SSN, EIN, driver’s license. All incomplete entries will be disqualified from consideration in the contest and NO REFUNDS shall be given to in the case of incomplete submissions.
Prizes:
1. 12 Months of Martial Arts Training for a family up to 4 members: Unlimited Martial Arts Classes in any program offered by Scornavacco Martial Arts Academy for one family of 1 to 4 students. In the event less than 4 family members take advantage of this prize, that portion of the prize shall be forfeit. The Grand Prize will only be awarded with a minimum of 25 entrants. Prize does not include test fees or required training gear.
2. 12 Months of Martial Arts Training for 1 family member: Unlimited Martial Arts Classes in any program offered by Scornavacco Martial Arts Academy for 1 student. 1st Prize will substituted for the Grand Prize with a minimum of 15 entrants and a maximum of 24 entrants. Prize does not include test fees or required training gear.
3. Training must take place during the following window: Thursday, April 7, 2012-Friday, April 6th, 2013.
4. While training, Winner will work with the staff of Scornavacco Martial Arts Academy in person for martial arts training and consulting. Training times will be in the age-appropriate class from Friday and Saturday according to the current class schedule. In the event Winner cannot attend the offered classes, prize will be forfeit.
All prizes are subject to availability. Contest Sponsor may substitute prizes of similar value at its sole and full discretion. Contest Sponsor has full discretion to chose the vendors used to deliver any or all of the prize elements. Date for final delivery of all prizes will be determined by Sponsor in its sole discretion. There is no substitution, transfer, or cash value for prizes. Other restrictions may apply.
Acceptance of Prize: Contestant must respond within 7 days of receipt of notification as a finalist or winner with their intent to accept the prize and any other required information requested by Contest Sponsor per these Rules. Finalists will be notified via registered email. Winner will be notified by registered email, listed in broadcast email, and posted on Contest Website. If contestant fails to deliver notification of acceptance to Sponsor within 7-days from receipt of registered email period, then contestant forfeits all right to prize.
Substitutions: No substitution, assignment or transfer of prize permitted without prior written consent of Sponsor; except by Sponsor, who reserves the right to substitute a prize or prize component with another of comparable or greater value. Winner is responsible for all taxes and fees associated with prize receipt and/or use.
Publicity, Copyright Ownership and License: Except where prohibited, participation in the CONTEST constitutes entrant’s consent to Sponsor’s use of Entrants’ CONTEST SUBMISSION ESSAY, name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes in any media without further notice, payment or consideration.
General Conditions: Sponsor reserves the right to cancel or modify the CONTEST if fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity of the CONTEST, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prize at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the CONTEST or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the CONTEST is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Release: By entering this CONTEST, entrant agrees to release and hold harmless, CONTEST Entities & Sponsors from and against any claim or cause of action arising out of participation in the CONTEST or receipt or use of any prize.
Limitations of Liability: CONTEST Entities shall have no responsibility or liability (including, but not limited to, liability for any property loss, damage, personal injury or death) in connection with: (i) participation in this CONTEST; (ii) human error; (iii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software, delay in operation or transmission, communications line failure, technology outage, theft or destruction or unauthorized access to, or alteration of entries, whether caused by the sender or any of the equipment or programming associated with or utilized in the CONTEST; (iv) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (v) unauthorized human intervention in any part of the entry process or the CONTEST; (vi) electronic or human error which may occur in the administration of the CONTEST or the processing of entries; (vii) acceptance/possession, use/misuse, and/or defects of prize or prize component; or (viii) any injury or damage to persons or property, including but not limited to entrant’s computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the CONTEST. Entrants further agree to indemnify and hold harmless the CONTEST Entities from any and all liability resulting or arising from the CONTEST, to release all rights to bring any claim, action or proceeding against the CONTEST Entities.
Disputes: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with the CONTEST, or any prizes awarded, other than the administration of the CONTEST or the determination of winners shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of Colorado or the appropriate Colorado State Court located in the county of Boulder; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the CONTEST but in no event attorneys’ fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the CONTEST, shall be governed by, and construed in accordance with, the laws of the State of Colorado, without giving effect to such State’s conflict of law rules.

Winners List: CONTEST results and a copy of these Official Rules may be obtained by sending a self-addressed, stamped envelope to $11K Contest That Changes Lives, Scornavacco Martial Arts Academy 1830 Boston Avenue Suite F, Longmont, Colorado 80501. Requests must be within 10 days of the end of the Promotion Period.
Winners Announced: Winners shall be announced via broadcast Email and post on the CONTEST site by 5pm MST on Thursday, April 7, 2012.
Administration: Administrator has made a good faith effort to comply with all legal requirements in structuring this Contest and does not wish to accept entries from residents of jurisdictions where the Contest violates the laws of the jurisdiction in which the contestant resides. (i) If any governmental or judicial entity determines that a contestant violates applicable laws or regulations, the Administrator shall have the option, in its sole discretion, to disqualify the contestant. (ii) Administrator makes no representation regarding accessing the materials on this Site from jurisdictions where its contents or the Contest is illegal or prohibited. (iii) Those users who choose to access this Site from other locations do so at their own risk and are responsible for compliance with all local laws and regulations.
Severability of Illegal Provisions: Wherever possible, each provision of the Rules and Regulations shall be interpreted in such a manner as to be effective and valid under applicable law. Should any portion of this document be declared invalid for any reason, such declaration shall have no effect upon the remaining portions.
Rights of Third Parties: Unless expressly stated herein to the contrary, nothing in these Rules and Regulations, whether express or implied, is intended to confer any rights or remedies under or by reason of these rules on any persons other than the parties hereto and their respective legal representatives, successors and permitted assigns.
Amendment of Rules: Administrator may amend the Official Rules in its sole discretion. Amendments will be posted on the Administrator Website at http://www.scornavacco.com/11k-contest-rules.html. Unless otherwise specified, any amendments will become effective on the day they are posted on the Administrator’s website.
Entire Agreement: These Rules and Regulations, including exhibits, (if any) contain all agreements between the Administrator and contestants. There are no other representations, warranties, promises, agreements or understandings, oral, written or implied, among the Parties, except to the extent reference is made thereto in these rules.
